while pirating international software is fair game. I like it.

<chuckle>  This ought to be fun to watch - given the implied verbage around this issue will be "Do what you want, as long as you do not hurt your fellow Chinese."

Odds are, it going to be a rough and ready period for Chinese policemen and copyright lawyers, because Chinese criminals have been given too much of leeway for too long.

Actually, Brain, the West was historically profligate with knowledge, exchanging it with everyone and setting up schools to teach it everywhere. The Chinese were notorious for not revealing what they had learned--paper is a good example, as is sericulture.

When IP is Abused

IP serves certain functions, but the main effect in the software field is monopoly.  The use of such monopoly by foreign enterprises to snuff out China's budding software industry has results for all to observe.  

Just as the EU courts find Microsoft guilty of various bad deeds of antitrust, China should be vigilant, and as China's software industry is a lot less mature than that in Europe (and thus needs more help), new laws should be promulgated to ensure that those who abuse their IP positions to attain monopoly, must not be able to enforce their IP in China.   The two are simply not compatible, and the protection of the consumer should come first.

Microsoft has a monopoly primarily because its competitors did not move appropriately to capture the market. IBM refused to develop a viable operating system and GUI until it was too late and Apple sabotaged themselves by missing the PC revolution. Microsoft didn't become a monopoly because of bullying, it became one because everyone bet on Macs or didn't develop anything worth using (I remember when people who used OS/2 could still be found easily, they were a sad bunch), so when PCs started to hit every market and displace Macs, MS had the only product for them.

So MS isn't a good example, especially since their constant placement of new products puts them well into the field anyhow. The good example is UNIX and whoever owns it: the current owner almost shut down Linux by arguing that it violated UNIX's copyrights. That's using IP to undermine innovation and promote a monopoly.
