         Futurewei is Huawei’s US-based research and development arm and employing hundreds of people at offices in Silicon Valley and the greater Seattle, Chicago and Dallas areas...

Huawei files lawsuit against US Commerce Department over seized equipment.


   Huawei Technologies filed a lawsuit against the US Commerce Department on Friday challenging whether telecommunications equipment it sent from China to the United States, and then back to China, is covered by Export Administration Regulations, according to a court filing.

In the lawsuit, Huawei said that it shipped telecommunications equipment from China, including a computer server and ethernet switch, to a testing laboratory in California. After the testing was done, the equipment was shipped back to China. No application for a license was made because none was needed, the lawsuit claims.

But the equipment was seized in Alaska by the US government, and no decision has been made about whether a license is required to ship it, the filing said.

“The equipment, to the best of HT USA’s knowledge, remains in a bureaucratic limbo in an Alaskan warehouse,” Huawei said in its lawsuit.

    The equipment was seized by the US government while on its way back to China in September 2017, and no decision has been made about what to do with it, the filing said.

Huawei has just lost a court judgment for misappropriation of trade secrets involving a memory control technology and for poaching its employees. You really think Huawei will win? Think again. In the meantime, both sides are digging in.

At this point both sides should pack it up and go home. After all the peeps on this forum want the US out. Minimally the US should impose exactly what China is doing to the US all these years. Even better, China changes the way they do business. The playing field has been uneven for a long time. Time to even it out.

Futurewei is a privately owned company of Huawei. What makes you think it's an exception?

The U.S. Commerce Department sent a letter to Futurewei, Huawei’s Santa Clara, California-based research-and-development unit, stating that it intends to deny Futurewei’s application to renew its export license because of national security concerns. The license reportedly covered the export of telecommunications technology and software, including high-speed data-transfer technology.


So it looks like you should take your own advice;
