The two Canadians can also be "more free" if they put up their homes, cash assets, and agree to walk about with electronic anklets; but alas, they have nothing to put up for bail, so their must stay behind bars!!  That is the law!

You wouldn't know anything about their case, because this is China. They are held on grounds of national security, and that's all you know.

That's a questionable term in China, but if any person would be held on those charges (national security) in other countries (Canada included), they wouldn't get on bail either.

Secondly, if China was more open with things like buying property or investing, perhaps these specific individuals would have assets in China.

If they'd be required to produce bail money from their foreign assets, then good luck getting around China's foreign exchange controls, which if I recall correctly amount to 50 000 USD per year per individual.

Individual States have the death penalty only for the most heinous of crimes. China seems to drop the death penalty down at the drop of a hat, depending on the presiding judge. There are only a few crimes in China which do NOT have the death penalty as a "maximum punishment". You deal it out with impunity. There's the difference, Snowflake. The United States has the Death Penalty only for the severest of criminal offences. China has it as an all-around punishment.

I guess the fact that the Chinese legal system does not have "bail" doesn't play into the equation at all, right?

Why should China, or for that matter any other country, take the United States as their model?  The US is in such chaotic state with the Shutdown and more than 800,000 Federal employees out of work, or work for no pay, how can it claim the moral high ground?  China has its own unique problems with crime, and it has to impose the death penalty whenever the court thinks fit!  It does not need some foreign do gooders telling it how to deal with criminals!
