I signed a contract with a local property developer last year. The developer promised to finish the apartments and to get certificates before Oct 31, 2012. However, the developer failed.

In Feb, 2013, the developer published a notice. All of contractors (apartments' owners) need to sign the papers to receive the apartments from Feb 28. The developer won't pay or pay part of penalty for breach of contract.

After had received the notice, I sent a mail to city construction buruea and urban planning bureau for help. The officials replied that the partments hadn't passed quality and planning checks yet. The gov don’t know if the contractors(including me) could get apartments’ ownership certificates or not yet. The apartment owners have legal rights to refuse to receive the apartments. The developer would break laws if the developer forced contractors to receive the apartments.

Yesterday about 100 contractors gathered before the office of the developer. Some of contractors suggested to ask for help from newspapers and TV stations. Some of contractors suggested to appeal before city gov building. With the help of journalists from local newspapers and TV stations, the negotiation was going from 9 a.m. to nearly 12 p.m. At last the developer promised to pay penalty for breach of contract. The developer also promised to pass the quality and planning check. before Oct 1, 2013.

In the past, many people hanging the slogans would block the main road if their benefits and interests had been hurt by property developers. The local gov began to solve the problems after the main road had been blocked. Some contractors suggested to get justice like that. Some others replied that it was the last resort if we tried and failed to get help from local media, from local gov and from local law court.

Buying apartments of a plan before completion is very dangerous in China.

The game rules in property market:

Here all land in cities are owned by local gov. Single citizen is prohibited to build its own apartments and houses in laws and regulations. Local gov used to sell lands to property developers. So, we have to buy apartments and houses from property developers.

Also in laws and regulations, the property developers could sell out all of apartments before the apartments were finished.

In the present game rules made by gov, we usually have to buy apartments of a plan before completion. We have to take the risks.

Property developers used to accuse journalists of getting benefits and interests from the conflicts between property developers and contractors (futural housing owners).

However, many contractors sometimes would get help at last. Local gov would often begin to solve the problems after the conflicts were posted in media. Some of property developers also fear the power of media.

If conflicts happened, many contractors would first try to seek helps from media.

Sad but true. I still live in an appartment with no certificate of property because the building hasn't got license from the housing autorities.
