The drafting of "mental health law" began from 1985. after 26 years, at last it appeared. Today, Central government disclosed the draft of "Mental health law" to get advice.

From the official data in 2009, 1 in 10 Chinese had mental problems, More than 1 in 100 Chinese had serious mental problems.

1. Patient has the right to decide Whether to be cured in hospital or not.

2. Patient would be forced to be cured in hospital if mental patient injured himself or others, or hurt the public security. Patient and their family members have the rights to double diagnosis in any provincial-level qualified organization.

3. Voilating this law, anyone, who forces others to diagnosis, or who sends sane people hospital, or who illegally restricts insane patient leaving hospital, will assume the criminal and civil liability.
