The case of Gammy, a baby with Down's syndrome and heart infection who was born to a Thai surrogate mother,Pattharamon Chanbua, and allegedly left behind by the intended Australian parents,Davis and Wendy Farnell, has caused international controversy.

However,the Australian couple said they wanted to take their left child home.David and Wendy Farnell, speaking publicly for the first time, insisted the Thai mother would not hand over Gammy, the seven-month-old baby boy. They say they will fight to get Gammy back.


Before that,the surrogate mother says the couple deliberately left Gammy behind because of his disabilities.The couple, which denies this, had earlier told Australian media they did not know of his existence, and that Pattharamon Chanbua, 21, was lying.
In an exclusive interview on Sunday, David Farnell said: "We did not abandon our son.
"The surrogate mother - it is her choice if she wants to give you the baby or not give you the baby. Although you have a surrogacy agreement, it really doesn't mean anything. It is her decision, and our surrogate mother said that she wanted to keep the baby boy."

Surrogacy laws vary from country to country.Countries such as Germany,Italy,France,Spain,Portugal prohibit all forms of surrogacy.In countries including the UK, Ireland, Denmark and Belgium, surrogacy is allowed where the surrogate mother is not paid, or only paid for reasonable expenses. Paying the mother a fee (known as commercial surrogacy) is prohibited.Commercial surrogacy is legal in some US states, and countries including India, Russia and Ukraine. People who want to be parents may go abroad if their home country does not allow surrogacy, or if they cannot find a surrogate.
However, even here, the laws may vary. For example, some Australian states have criminalised going to another country for commercial surrogacy, while others permit it.

There are no internationally recognised laws for surrogacy, so many parents and children can be left vulnerable - or even stateless.It can take several months to bring a surrogate baby back to the parents' home country, as they may not be automatically recognised as the legal parents.In Thailand, surrogates are seen as the legal mother, so if the parents leave the baby with the mother, she is legally responsible. This is one of the difficulties seen in the Gammy case.

There are already far too many people in the world and so far China has been the only major nation
to do anything about this with their one-child policy.
To bring more people into the world is insane. We should be limiting every couple to one-child
throughout the world.
Surrogacy is only going to compound the over population problem.
If capitalism promotes innovation and creativity then why aren't scientists and artists the richest people in a capitalist nation?

Western lawers can hardly keep a smirk of their faces when the converstion comes to it...
In America we have arrived at the point where kids believe their parents OWE them college, and about everything else, even when they have reached what most people deem maturity.  Imagine the ramifications and  how many Liberals’ children will be suing their parents?
the system is so messed up when You sue a minor you sue their parents because all responsibility falls to them. The parent cannot recoup that through the court system from their child.
Aside the FUTURE legal problem, I'd not worry too much... But hard to comprehand how Western people can be so ignorant of their own and guest Laws...the parent-child relationship is given special legal consideration...anywhere as long as it'll benefit the local coffers...
It takes about 40 muscles to smile, but only 4 to pull the trigger of a decent rifle

Agree that overpopulation problem is severe in some countries,but not all,even china is entering ageing period.
If every family could have only one child,when the child grows up and establish a family,this young couple would attend four elder people,with work pressure added,they would feel very tired.
